Email Policy
Mass Mailings: UPOINT has a zero stance policy on SPAM, Junk E-mail or UCE. Spam, Junk-mail and UCE are defined as: the sending of the same, or substantially similar, unsolicited electronic mail messages, whether commercial or not, to more than one recipient. A message is considered unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. UCE also includes e-mail with forged headers, compromised mail server relays, and false contact information. This prohibition extends to the sending of unsolicited mass mailings from another service, which in any way implicates the use of UPOINT whether or not the message actually originated from our network.

Mailing Lists: UPOINT's mass mailing rules also apply to mailing lists, list servs, or mailing services you may contract with. The policy is stated as follows: An acceptable mailing list will be focused at a targeted audience that has voluntarily signed up (using the closed-loop opt-in*1 method) for your e-mail information or that has made their e-mail address available for distribution of information from you. The list must also allow for automatic removal by all end Customers with non-distribution in the future.

*1 Also known as "Confirmed Opt-in" or "Verified Opt-in". The Recipient has verifiably confirmed permission for the address to be included on the specific mailing list, by confirming (responding to) the list subscription request verification. This is the standard practice for all Internet mailing lists, it ensures users are properly subscribed from a working address and with the address owner's consent.

UPOINT may terminate the term and Subscriber's right to use the service at any time without cause by sending notice to the Subscriber. UPOINT may Terminate the term and subscriber's right to use the service immediately without prior notice on a breach of the these Terms and Conditions by Subscriber. Terminations by subscriber will be effective immediately on the date on which UPOINT receives notice from the Subscriber, provided that there is no outstanding payment, and no refund will be given for the unused period. No refunds will be given if the Subscriber cancels the Services, or if UPOINT cancels the Services due to a breach of these Terms and Conditions, and under no circumstances will any termination of this contract result in a refund exceeding the unused portion of any fees paid to UPOINT.
